Privacy Policy
SERWIND Inc. DBA: SKIWARRIOR (collectively, " SKIWARRIOR," "we," "us," and "our") provides smart wireless intercom audio ski goggles, accessories and apps that enable our customers to enjoy skiing. We respect the privacy of our customers, employees and candidates and are committed to protecting the personal information you share with us. We also protect the privacy of our website visitors, site visitors, followers, vendors, service providers, partners, and others who contact us (collectively, these individuals and any others from whom we collect personal information are referred to as "customers" or "you" or "data subjects"). This Privacy Policy is designed to help you understand how we collect, use, process and share your personal information and to help you understand and exercise your privacy rights.
1. SCOPE
This Privacy Policy applies to personal information processed by us, including on our websites, mobile applications, as well as in job applications, and other online or offline offerings. To make this Privacy Policy easier to read, our websites, mobile applications, job posts and other offerings are collectively called "Services".
SKIWARRIOR is the controller ("Controller") for the personal information we process, unless otherwise stated. For information on how to contact us, please refer to "Contact Us" below.
2. PERSONAL INFORMATION WE COLLECT
The types of personal information we collect depend on the way you interact with us, our Services, and the requirements of applicable law. We collect information that you provide to us, information that we obtain automatically when you use our Services, and information from other sources such as third party services and organizations, as described below.
2.1 Information You Provide to Us Directly
We may collect the following personal information that you provide to us.
A. Purchase Information
When you purchase our snow goggles and other products and register for our services, we may collect information such as full name, email address, phone number, device information, profile picture, payment information (including billing information), date of birth/expected date of delivery, and any other information you provide.
B. Usage Information
When you use our snow goggles, related products and applications, we collect information such as full name, email address, country/region, profile picture, user time zone, WiFi network name, IP address, usage information, geographic location where Bluetooth pairing is enabled, and any other data you provide, including pictures, videos and more.
C. Communications
We collect information about you in our loyalty program when you fill out forms or enter information directly into our websites and apps, or when you communicate directly with us, such as when you sign up for a free trial, request information about our services, download a guide, participate, refer a friend, write a review, complete a survey, sign up for a newsletter/email list/blog, or request customer and technical support.
D. Surveys
We may contact you to participate in surveys. If you decide to participate, you may be asked to provide certain information, which may include personal information.
E. Interactive Features
We and others who use our Services may collect personal information that you submit or provide through our interactive features (such as messaging and chat features, commenting features, forums, blogs and social media pages). Any information you provide using the public sharing features of the Services (referred to herein as "User Content") will be considered "public" unless otherwise required by applicable law and is not subject to the privacy protections referenced herein. Please exercise caution and comply with the applicable Terms of Use before disclosing any information that could identify you in the real world to other users.
F. Conferences, Trade Shows, and Other Events
We may collect personal information from individuals when we attend conferences, trade shows, and other events.
G. Business Development and Strategic Partnerships
We may collect personal information from individuals and third parties to evaluate and pursue potential business and research opportunities. This includes contact information and any other information that our authorized retailers, service providers, suppliers, resellers, distributors, agents, or participants in our affiliate programs provide to us.
H. Data Relating to Employment Candidates
This includes resumes, CVs and the data contained therein, minutes of meetings, standardized tests, reports, references, interviewer impressions and such industry-standard data, as well as the collection of data that is made publicly available or provided to us on social networks. We collect such data based on a candidate's intent to enter into an employment agreement with us.
2.2 Automatically Collected Information
We may automatically collect personal information when you use our services, including when you use our websites and applications:
A. Automated Data Collection
When you use our Services, we may automatically collect certain information, such as your Internet Protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location based on IP address), and Internet service provider. We may also automatically collect information about your use of our Services, such as the pages you visit before, during, and after you use our Services, information about the links you click, the types of content you interact with, the frequency and duration of your activity, and other information about how you use our Services. In addition, we may collect information about you that others provide while using our Services, including information about you when they tag you.
B. Location Information
We may ask you to enable the sharing of precise location information on your device in order for our services to function properly, but we do not collect or store your precise location.
C. Cookies, Pixel Tags/Web Beacons and Other Technologies
We, as well as third parties who provide content, advertising, or other features on our Services, may use cookies, pixel tags, local storage, and other technologies ("Technologies") to automatically collect information through your use of our Services.
D. Cookie
Cookies are small text files placed in your device's browser to store preferences and to facilitate and enhance your experience.
E. Pixel Tags/Web Beacons
A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that is used to collect information about engagement with our Services. For example, the use of pixel tags allows us to record that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in emails to see if the email has been opened, executed or forwarded.
2.3 Our Use of These Techniques Falls into the Following General Categories:
A. For Basic Website Purposes
This includes technologies that allow you to access our services, applications, and tools that are needed to identify irregular website behavior, prevent fraudulent activity, and improve security, or that allow you to use our features;
B. Performance/Analysis Related
We may use technology to evaluate the performance of our services, including as part of our analytics practice, to help us understand how individuals use our services (see Analytics below);
C. Marketing Related

2.4 Other Information About the Technologies We Use:
A. Duration of the Technology.
Session cookies are used to track your online activity during a given browsing session; they usually expire when your browser is closed, but may remain on your device for some time. Persistent cookies continue to operate even if you close your browser; they are used to remember your login details and password. Third party cookies are installed by third parties to collect certain information to study behavior and demographics. Third party cookies on our website may include Google Analytics, for example. Similarly, pixels from third parties may be integrated with third party service providers that we embed on some of our websites (e.g. Facebook, Twitter, YouTube, Pinterest, Instagram). Third party cookies will be retained in accordance with the terms of these third parties and you can control these cookies in your browser settings.
B. Control of Certain Technologies
Our website has a cookie control tool installed that allows you to approve the placement of cookies according to their different categories. The tool provides complete and up-to-date information about each website. You can use the tool to accept the placement of cookies or, if you do not accept the placement of cookies, no non-essential cookies will be placed. please note that accepting or rejecting cookies is specific to each device and each browser. Our use of cookies assumes that you agree to their placement on your device through the use of our cookie management tool. Cookies placed before we installed our cookie management tools are based on our legitimate interest in improving, optimizing and personalizing our services.
C. Limiting the Impact of Cookies
If you choose to block or delete cookies, your online experience on our site will be limited. Most browsers will allow you to delete cookies from your device, block acceptance of cookies, or receive a warning before a cookie is stored. The effect of disabling or deleting cookies depends on which cookies you disable, but in general, the Website and certain services offered through the Website may not function properly, may not recognize your device, may not remember your preferences, etc. We may not be able to generate cookies for you if you choose to block or delete cookies. Deleting other cookies will mean that we will not be able to generate insights and analytics about the use of our website or personalize content. 3.3 Other Purposes
We will also use your information for other purposes as requested by you or as permitted by applicable law.
We may use personal information for other purposes that are explicitly disclosed to you or with your consent at the time you provide the personal information.
A. Automated Decision Making
We may be involved in automated decision-making, including analytics, and SKIWARRIOR's processing of your personal information will not result in decisions that materially affect you solely on the basis of the automated processing, unless such decisions are part of our contract with you, we have your consent, or we are permitted by law to be involved in such automated decision-making. If you have questions about our automated decision making, you can contact us as set out in the "Contact Us" section below.
B. De-identified and Aggregated Information
We may create de-identified and aggregated information using your Personal Information and other data sources, including de-identified demographic information, location data, device information, and other analytics. These analytics may then be shared with third parties or made publicly available.
C. Share Content with Friends or Colleagues
Our Services may offer a variety of tools and features. For example, we may allow you to provide information about your friends through our referral service. Our referral services may allow you to forward or share certain content with friends or colleagues, such as emails inviting your friends to use our Services. Please only share contact information with us about people with whom you have a relationship, such as relatives, friends neighbors, or co-workers.

4.2 Disclosure for Our Protection or that of Others
We may access, preserve, and disclose to outside parties any information we store about you if we believe in good faith that it is necessary or appropriate to do so: to comply with law enforcement or national security requests and legal process, such as a court order or subpoena; to protect your, our, or another person's rights, property, or safety; to enforce our policies or contracts; to collect money owed to us; or to assist in the investigation or prosecution of suspected or actual illegal activity.
4.3 Disclosure Upon Merger, Sale or Other Transfer of Assets
If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, purchase or sale of assets, or transfer of services to another provider, then where permitted, your information may be sold or transferred as part of such transaction by law and/or contract.

5.1 Your Privacy Choices
The privacy choices you may have regarding your personal information are determined by applicable law, as described below.

A. If you receive unwanted emails from us, you can opt out by using the unsubscribe link at the bottom of the email. Please note that you will still receive transactional emails related to the product or service you've requested. We may also send you certain non-promotional communications about us and our Services. You will not be able to opt out of these communications, such as updates to our Services, our Terms, or this Privacy Policy.
B. Text Messaging
You may opt out of receiving text messages from us by following the instructions in the text messages you receive from us or by otherwise contacting us.
C. Mobile Device (smartphone, tablet, etc)
We may send you push notifications through our mobile applications. You can opt out of receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information through our mobile applications. You may opt out of this collection by changing the settings on your mobile device.
D. "DNT"
Do Not Track ("DNT") is a privacy preference that users can set in some web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
E. Cookies and Interest-Based Advertising
You can stop or limit the placement of technology on your device or remove it by adjusting your preferences as your browser or device allows. However, if you adjust your preferences, our Services may not function properly. Please note that cookie-based opt-outs do not work on mobile applications. However, you may opt out of personalized advertising on certain mobile applications by following the instructions for Android, iOS and other mobile applications.
F. The online advertising industry also offers websites where you can opt out of receiving targeted ads from data partners and other advertising partners participating in self-regulatory programs. You can access these and learn more about targeted advertising, consumer choice and privacy by visiting the Network Advertising Initiative, the Digital Advertising Alliance, the European Digital Advertising Alliance and the Canadian Digital Advertising Alliance.
Please note that you must opt out separately for each browser and each device.
5.2 Your Right to Privacy
You may be entitled to under applicable law:
Access to personal information about you , including:
A. To confirm whether we are processing your personal information;
B. Obtain access to or a copy of your personal information in a structured, commonly used and machine-readable format;
C. Receive an electronic copy of the personal information you provide to us or request that we send that information to another company in a structured, commonly used and machine-readable format ("Data Portability Rights");
5.3 If your personal information is inaccurate or incomplete, request a correction. In some cases, we may provide self-service tools to enable you to update your personal information;
A. Request deletion of your personal information;
B. Requests to restrict or object to our processing of your personal information, including processing your personal information on the basis of our legitimate interests or for direct marketing purposes;
C. withdraw your consent to our processing of your personal information. Withdrawal of your consent will not affect the lawfulness of any processing based on your consent prior to the withdrawal;
5.4 Knowing the Third Parties with Whom You Share Personal Information
Requests for review of decisions taken exclusively on the basis of automated processing if they may affect the rights of the data subject.

The rights described are not absolute and may vary depending on the privacy laws that apply to your information and, in some cases, we may deny the request as permitted by law.
6. Security of Your Information
6.1 We take steps to ensure that your information is treated securely and in accordance with this privacy policy. Unfortunately, no system is 100% secure and we cannot ensure or warrant the security of any information you provide to us. We have put in place appropriate safeguards to require that your personal information is protected, and we require our third party service providers and partners to put in place appropriate safeguards as well. To the maximum extent permitted by applicable law, we are not liable for unauthorized disclosure.
6.2 By using our Services or providing us with personal information, you agree that we may communicate with you electronically about security, privacy and administrative issues related to your use of our Services. If we learn of a breach of security, we may attempt to notify you electronically by posting a notice on our Services, by mail, or by sending you an e-mail.
7. International Data Transfer
7.1 All information we process may be transferred, processed and stored anywhere in the world, including, but not limited to, the United States, Israel or other countries where data protection laws may differ from the laws of your place of residence. We endeavor to protect your information as required by applicable law.

8. Retention of Personal Information
8.1 We store the personal information we collect as described in this Privacy Policy for as long as you use our services or as necessary to fulfill the purposes for which the information was collected, to provide our services, to resolve disputes, to establish legal defenses, to conduct audits. 9.1 The Services are not intended for, nor are they intended to be operated by, children under the age of 16 (or such other age as may be required by local law) and we do not knowingly collect personal information about children as customers.

If we discover that a child has provided us with Personal Information in violation of applicable law, we will delete any Personal Information we have collected (unless we are legally obligated to retain it) and terminate the child's account.
10. Other Provisions
10.1 Third Party Websites/Applications. The Services may contain links to other websites/applications which may refer or link to our Services. These third party services are not under our control. We encourage Users to read the privacy policy of each website and application with which they interact. We do not endorse, screen or approve the privacy practices or content of such other websites or applications and are not responsible for them. Providing personal information to third party websites or applications is at your own risk.
10.2 Supervisory Authorities. If you are located in the European Economic Area, Switzerland, the United Kingdom or Brazil, you have the right to file a complaint with a supervisory authority if you believe that our processing of your Personal Information violates applicable law.
10.3 Changes to Our Privacy Policy. We may modify this Privacy Policy from time to time in our sole discretion. We will notify you of any material changes to this Privacy Policy as required by applicable law. You understand and agree that if you continue to use our Services after the effective date of a new Privacy Policy, you will be deemed to have accepted the updated Privacy Policy.
